Smoke & Carbon Monoxide Alarm regulations

Here’s a quick overview to help you stay on top of these important requirements:

Smoke and Carbon Monoxide Alarm Regulations:

England and Wales:

  • Smoke Alarms: You must install at least one working smoke alarm on each floor of your rental property.
  • Carbon Monoxide Alarms: Required in all rooms with a solid fuel-burning appliance (e.g., coal fire, wood-burning stove) or a gas or oil-fired boiler. A CO alarm is also necessary when any solid fuel-burning appliance is installed or replaced.

Landlord Responsibilities:

  • Start of Tenancy: It’s your duty to check that each alarm is functioning at the beginning of every new tenancy. Testing alarms during regular inspections is also a good practice.
  • Tenant Confirmation: Consider having tenants sign a document confirming they witnessed the alarms being tested and found them in working order at the start of the tenancy.
  • Maintenance: If a tenant reports a fault with a smoke or CO alarm, it is your responsibility to repair or replace it promptly.

Houses in Multiple Occupation (HMOs): For HMOs in England and Wales, additional requirements apply:

  • Smoke Alarms: Must be installed on each storey with living accommodation and in each individual unit (bedroom or bedsit).
  • Heat Alarms: Required in high-risk rooms such as kitchens.
  • Interconnected Alarms: Alarms must be interconnected and mains powered. For HMOs with three storeys or higher, an appropriate alarm system with a central panel must be installed.
  • Regular Maintenance: Ensure the alarm system is maintained regularly by a competent person, typically every six months, according to the manufacturer’s instructions. Be prepared to provide evidence of regular checking and servicing to the local authority if requested.

Staying compliant with these regulations not only helps protect your tenants but also safeguards you from potential legal issues. Regular checks and maintenance of your smoke and CO alarms are small steps that can make a significant difference.
